Russell H. Fritz and a large number of other petitioners brought suit against V. S. Beem, Eugene V. Haynes, and Haynes Manor, a corporation, alleging the following: All of the petitioners are owners of lots in a residential subdivision in the County of Fulton called ""Haynes Manor,"" each petitioner residing on his lot located in the subdivision, and the defendant Beem owning lot 11 in block 17, which was deeded to him by the corporation, Haynes Manor, and he is preparing to build a house on said lot and has obtained a building permit for the erection of a residence at a cost of $6250.
